A respected cricket coach who fractured a man’s hip and wrist when he pushed him over in the street has been spared an immediate jail sentence.
Graham Sivyer had downed seven pints of lager on a night out with his wife and friends when he knocked down window cleaner Graham Brennan after words were exchanged outside the Future Balti Indian restaurant in Wibsey town centre, Bradford Crown Court heard yesterday.
Sivyer, 50, of Ash Grove, Wibsey, pleaded guilty to causing Mr Brennan grievous bodily harm at 12.50am on September 18 last year.
Prosecutor Giles Bridge said he pushed 45-year-old Mr Brennan in the chest and he fell across the kerb, partly on the pavement and partly in the road.
Mr Bridge said he was in agony and was treated at the scene before being taken by ambulance to Bradford Royal Infirmary.
He needed surgery on a fractured left hip and a broken wrist.
Mr Bridge said Sivyer told the injured Mr Brennan: “There’s nowt wrong with you” and labelled him “a drama queen” as he lay injured on the ground.
Sivyer was arrested at the scene and told police he had drunk seven pints of lager that night.
Mr Bridge said Mr Brennan had just set up a window cleaning business at the time and could no longer work.
He had difficulty sleeping and had suffered nerve damage. He also feared he could lose his rented home because he was no longer able to work.
Judge Jonathan Rose said Sivyer’s character had previously been impeccable. He added: “This was foolishness because there is no germ of violence within you.”
He said Sivyer had not intended to seriously hurt Mr Brennan.
Sivyer was sentenced to 12 months’ imprisonment, suspended for two years, with 180 hours of unpaid work for the community.
He was ordered to pay £1,000 compensation to Mr Brennan.
