The owner of a takeaway restaurant at 453 Bradford Road, Sandbeds, has been fined £2,250 for breaking planning laws and ordered to pay costs to Bradford council of £965.
The council's Keighley planning sub-committee was told yesterday the defendant had failed to attend the town's magistrates court and that the case was found proved in his absence.
The case followed the council's refusal to vary opening hours following complaints by neighbours that the premises were being opened outside the times allowed by planning permission.
Following a successful appeal last June the owner was allowed to continue the use of the premises without the original conditions. But a new condition was imposed allowing the use only between 11am and 11pm from Monday to Saturday.
Neighbours again complained that the takeaway was open beyond permitted hours.
When a breach of condition notice served last September was ignored prosecution proceedings began.
