A 16-year-old student, who is alleged to have raped a 15-year-old girl at a New Year pyjama party, told a Court that she had instigated the sex.

The teenager, now 17, who denies raping the girl and sexually assaulting her, told Bradford Crown Court today that she had stumbled into the bathroom while he was there.

He said they started kissing and ended up having sex but stopped after about ten seconds.

The teenager admitted the girl was crying when she left the bathroom. He did not know what was wrong and thought it best to stay away from her afterwards.

He denied a claim by prosecutor Kama Melly that he had lost control and had sex with her whether she wanted it or not.

Miss Melly has alleged the youth, who cannot be named because of his age, locked the girl in the bathroom at the Bradford house where the party was being held on New Year’s Eve in 2008.

The girl, now 16, told police she froze during the alleged sexual assault and then ran from the bathroom in tears.

The trial continues.
