A MAN who admitted assaulting his former partner was given a 46-weeks prison sentence yesterday, but walked free from court because of the time he had spent in custody.
Martin Holmes, 33, of Hainworth Wood Road, Keighley, denied two charges of causing actual bodily harm to Laura Hanley, but pleaded guilty at Bradford Crown Court to common assault.
He also pleaded guilty to driving over the prescribed alcohol limit and without insurance, and breaching a community order by failing to attend for unpaid work.
Prosecutor Charlotte Eastwood said Holmes had been in a relationship with the complainant for four years. On December 10 last year he collected her three-year-old son and was to return him later in the day, but failed to do so. She attended a flat in Victoria Road, Keighley. The defendant answered the door and there was an argument during which he pushed her over and she banged her head on a wall.
The next day he returned the boy to her home and there was another argument. She was again pushed and banged her face on a door. She suffered a small cut to the face and bruising to her legs.
Police were called and he was stopped in his vehicle and found to be over the drink drive limit.
Judge David Hatton QC imposed a restraining order prohibiting contact with the complainant. He disqualified Holmes from driving for 12 months.
