A celebrity lawyer says he has received a written apology over a speeding case in Bradford.
Nick Freeman, known as the ‘Loophole Lawyer,’ claims a series of blunders occurred in the prosecution of the case after a speeding ticket was issued when a car, registered to his company, was clocked driving in excess of the 50mph limit on the M606.
Mr Freeman is the managing director of Freeman Keep on Driving Ltd, the registered keeper of the car.
But he said the initial Notice of Intended Prosecution (NIP) was issued to Freeman Keep On Ltd, not Freeman Keep On Driving Ltd. Mr Freeman said no reminder was issued when there was no response to the initial NIP.
He said a summons was then issued against the Company Secretary of Freeman House, which is not a legal entity. Mr Freeman said Freeman Keep On Ltd, which does not exist, was convicted in its absence at Bradford and Keighley Magistrates’ Court and fined £1,100 and ordered to pay a £100 victim surcharge with £85 court costs.
Mr Freeman, whose clients include footballers and celebrities, wrote to the court pointing out the “technical errors” in the case. He said he had now received a written apology from the Courts Service, and confirmation that the distress warrant that had been issued had been voided, thus negating the entire penalty.
Mr Freeman said: “The amount of technical failures in this one speeding case was simply staggering. To make one mistake is bad enough, but to make four just beggars belief.
“Even though the NIP was sent to Freeman Keep On Ltd, which doesn’t exist, the summons was sent to the Company Secretary of Freeman House, which also does not exist! The incompetence has cost a great deal of time and money, and the taxpayer is footing the bill.”
A spokesman for Mr Freeman said he was not driving the vehicle, a MINI. He said the initial NIP had been received by the company but he had no idea if it had been responded to.
