HIGHWAYS ACT 1980 - SECTION 119 PUBLIC FOOTPATH NO. 64 (BINGLEY) (PART) HEIGHTS LANE ELDWICK BINGLEY PUBLIC PATH (DIVERSION) ORDER 2013
On 7th January 2016, the City of Bradford Metropolitan District Council confirmed the above Order made under Section 119 of the Highways Act 1980. The effect of the Order, as confirmed, is to divert that part of Public Footpath No. 64 (Bingley) as shown by a bold continuous line on map no. 66666/T195/Orderplan annexed to the Order as follows:-1. Length A-B-C-D - its full width which commences at point A - a field gate gap 45 metres south of Its junction with Tewitt Lane/Public Bridleway No. 73 (Bingley) and extends in a westerly then south westerly direction to Lower Heights Barn, then in a further south westerly and then north westerly direction for a total distance of 262 metres to point D.
An alternative Public Footpath will be created as shown by a bold broken line on map no. 66666/T195/Orderplan annexed to the Order as follows:-
1. A Public Footpath - length A-G-F-E-D - 2 metres wide which commences at the above-mentioned point A - and extends for a distance of 45 metres to point G at its junction with Tewitt Lane/Public Bridleway No. 73 (Bingley) and then extends in a south westerly direction for a distance of 199 metres to point D. A copy of the confirmed Order and the Order map has been deposited and may be inspected free of charge at the Customer Services Office, Ground Floor, City Hall, Bradford during normal office hours. Copies of the Order and map may be purchased.
The Order comes into force on 4th February 2016, but if a person aggrieved by the Order wants to question its validity or that of any provision contained in it on the ground that it is not within the powers of the Highways Act (as amended), or on the ground that any requirement of that Act or of any regulation made under it has not been complied with in relation to the confirmation of the Order, he may, under paragraph 2 of Schedule 2 to the Act as applied by paragraph 5 of Schedule 6 to the Act, within 6 weeks from 15th January 2016, make an application to the High Court.
